243. Candy in the Sisterhood Gift Shop

QUESTION: The Sisterhood gift shop regularly sells candy during the holiday period. A group of parents have objected that this practice is contrary to Jewish ethics as such an encouragement of candy consumption aids to the deterioration of teeth not only of children, but also adults. (Larry Dann, New York NY)ANSWER: There is a strong series of Jewish traditions which prohibit wounding oneself or in any way endangering one’s life (Deut 4.9; 4.15; Ber 32b; B K 91b; Yad Hil Rotzeah Ushemirat Hanefesh 11.4; Hil Shevuot 5.57; Hil Hovel Umazig 5.1). This concern for health also applies to the health of a neighbor (B K 91b; Yad Hil Rotzeah 11.4 ff; Shulhan Arukh Hoshen Mishpat 427; Yoreh Deah 116.5 and Isserles). These statements are clear, but here we are dealing with an item of food which is not necessarily injurious. In other words, if candy is consumed in large quantities it may not be healthy, or if individuals who consume candy do not take appropriate care of their teeth, it may also be injurious. The items in question are, however, not dangerous in themselves. This is true of a great many other materials and foods in general use. They may, if improperly used, lead to serious health problems. The problem lies with the user not the seller. This is true of foods with high cholesterol content, alcoholic beverages, etc. It would be appropriate for the Sisterhood to indicate that candy is only sold to adults or children with adults, thereby removing the objection that children who would normally not be permitted to purchase candy may do so at the Sisterhood Gift Shop. Furthermore, the Sisterhood may also wish to sponsor some specific programs which deal with health care for children not only in connection with the consumption of candy, but other matters as well. This would alleviate the fear of parents that their children are being misled by this important and very useful group within the congregation.March 1990
